Some important points

Please take a few minutes to read through the following page to understand the legal rights and obligations involved in submitting an idea through the Medtronic Eureka portal.

  1. A Submission is defined by the description of your idea that you upload via the Medtronic Eureka portal and should relate to a new medical device, therapy or service or an improvement of an existing medical device, therapy or service.

  2. Medtronic invests heavily in research and development and your Submission may have been previously disclosed to Medtronic by others, through the Eureka portal or otherwise. It may also happen that Medtronic has already started to develop, but not yet launched on the market, the medical device, therapy or service as described in your Submission. Medtronic assumes no obligation to inform you of any knowledge or discoveries it has about ideas that are the same as or similar to your Submission. Further, by receiving and evaluating your Submission, Medtronic is not representing or in any way implying that your idea is new, useful, and/or non-obvious.

  3. Medtronic is under no obligation to use your Submission in any way, including but not limited to investigating its feasibility. When assessing your Submission, Medtronic may at its sole discretion consider the business fit, novelty, and potential for implementation in a marketable product, among other factors. Medtronic may decide at its sole discretion not to develop your Submission into a product. Many factors influence Medtronic’s decision whether to develop your Submission to the marketplace, including the technical risks involved, the amount of investment capital required, the time to market, and a variety of other market and business considerations.

  4. Before you disclose your Submission to Medtronic, we suggest that you consult a patent attorney for professional advice how to protect your Submission. 

  5. Medtronic is under no obligation to return to you your Submission or any documents, samples, models, and/or any similar related thereto. We recommend that you keep a copy of everything you provide to Medtronic.

  6. You are free to disclose your Submission to other parties. We request that you do not disclose to others that Medtronic is reviewing your Submission. We further request that if you disclose your Submission or parts thereof to other parties, you do so under confidentiality, and that you maintain all communications with Medtronic confidential. If you publish or otherwise publicly disclose the Submission or parts thereof, we request that you inform Medtronic of such disclosure.

  7. Disclosure of the Submission or any other information to any Medtronic employee other than through Medtronic’s Eureka portal does not establish any obligation for or legal liability by Medtronic.

  8. You represent to Medtronic that you are the person who created the Submission, that you are not under any duty to assign and have not assigned any intellectual property rights relating to your Submission to anyone, that you are the sole owner of the  intellectual property rights relating to Submission, that there are no pending or anticipated claims in relation to the Submission, and that you have the full right to negotiate with Medtronic any agreement concerning your Submission. You agree to disclose to Medtronic any public oral or written disclosure of the Submission to any person or company, including the nature of the disclosure, the parties involved, and the date of the disclosure.

  9. Medtronic assumes no obligation to act in a consultative capacity regarding patentability, ownership, or commercial value or potential of your Submission.

  10. Unless you are a citizen or lawful permanent resident of the United States, you represent to Medtronic that you are not a national or resident of Cuba, Iran, Sudan, Syria or North Korea, and that you are not identified on the U.S. Treasury Department’s List of Specially Designated Nationals and Blocked Persons or the U.S. Commerce Department’s Denied Persons List.

  11. If you are less than 18 years old, a parent or legal guardian must sign any agreements with Medtronic.

  12. This website does not address all terms and conditions and is subject to change at any time. Medtronic reserves the right to change, modify, or amend the content or features of this website in whole or in part.
    Rely only on written or electronic signed agreements with the company.
